I grew up in Oaxaca, Mexico. Oaxaca is a very active city both during the day and during the night. Although the community is large with many streets, and great groups of diverse people, everybody seems to know each other. My family consisted of my parents, seven brothers, one sister, and myself. We were all very different despite being so closely related in age – each sibling being apart in age by only two years or less. Due to our proximity in age, each of us was closest to the sibling that was immediately older and/or younger in age. This way, the sibling who was immediately older in age would have to take care of the younger one, and so on. We had this system worked out, and it worked. I think that my mother felt the support that we had for her after we protected her during that violent moment, because she never allowed my father to hit her again. To be honest, I am not sure if he ever even tried. I like to believe that my mother never experienced my father’s violence ever again. I was very close to my mother and after that moment, I felt that she also felt closer to me. I feel like she appreciated my reaction to this violent situation. Thereafter, some of them have become liable under the civil penalties as enshrined in the Corporation Act. Preliminary Issues There are several breaches of laws in the given situation. There are some people who have misused the information that they received from GML. Yet there are others who have traded in the shares of MMM to derive personal gains and benefits out of the information that they received. Though there might be some because of whom no detriment was caused to the company on the whole but it should be noted that if the minutes of the meetings of GML would not have been available to them, they would not have gained these benefits[1]. Thus, the issues that arise in this matter may be outlined as follows: Whether Dr Dawes has incurred a liability under the Corporations Act for the benefits that he has drawn because of the investments made by his wife in the stocks of MMM? Whether Mr Foster has incurred any liability for having dealt in insider trading and making his new company QECG buy shares of MMM and thus become liable for prosecution? Whether any misappropriation of position has been made by Mr Huckenfusser and whether the personal gains that he has derived have made him liable for prosecution against him? Whether there is any liability of Mrs Duck and if anything wrong has been done by her in investing in the shares of MMM on getting information about the upcoming profits from Mr Huckenfusser? The facts in the matter are clearly indicative of the fact that some of the people as identified above are directors while others are pseudo directors and some are even simple employees of the company. Thus, all cannot be dealt with under the provisions of director cannot be done here. Thus all the issues have to be discussed independently in this matter. There might be some people who are liable for civil penalties while there might be others who have been an accomplice in the matter and have in fact not contravened any law[2]. Each of these issues shall be conclusively determined after making an analysis of the provisions of Corporations Law and making a note of the breached provisions of the law. Possible Breaches of the Corporations Law In order to successfully bring about a suit against a director or officer of a company, certain essential things needs to be proved under Section 183 of the Corporations Act. These are: That at the relevant time, the person against whom the suit is being instituted was an officer of the company under absolute authority[3]; That the alleged person directly acquired the information himself; That he could obtain the information because of his position as a director or officer of the company and had he not been in that position, he would not have obtained the information; That the person alleged made an improper use of the information that he received[4]; That the improper use in question was made directly by him so that he could gain something for himself in the matter; The same information that he has used could also have been used by him to cause some harm or detriment to the company[5]. Dr Dawes in the given instance got the information about the possible benefits of investing the stocks of MMM because he was enjoying the position of a director of the company and was also a member of the directorial meeting. He had given a clear indication to the company that he was declared insolvent and was not left with any assets. Thus, it can be said that no material facts were concealed from the company by Dr Dawes. Upon acquiring information about the shares of MMM, he advised his wife to make an investment in the shares. He also came to know about the possible fall in the prices of the shares because of his position and subsequently asked his wife to sell off the shares that she had bought. A good amount of returns were obtained by her by way of this transaction. It should be noted that though benefits were derived by Dr Dawes in the matter, no detriment was caused to the company because of his actions. All that Dr Dawes did was he invested his money in the stocks of the com pany and his wife derived benefits out of it. It should also be noted that Section 183 becomes applicable only in those conditions when benefits are derived by a director or an officer[6]. However, because of his insolvency, Dr Dawes was not eligible to become a director and to hold on to his directorship, no permission was taken from ASIC as well[7]. Thus, it can be said in this matter that Dr Dawes is not liable to get any civil penalties in the matter. Mr Foster was a former director of the company and he acquired the information of the stocks of MMM because of his position. He thereafter left GML and joined QECG as a director and used the information he gained in GML for the advantage of QECG. He advised the Board in QECG to invest in the shares of MMM and when he did this, he was not associated with GML in any way. However, it cannot be denied that the information that was received by him was only because of his advantageous position and had he not been present in the meeting, he would have not known about it[8]. Thus, there is no doubt over the fact that he made an advantageous use of his position and misused the gathered information there[9]. There was no option in the hands of QECG to know about the stock priced had Mr Foster not told them about it. There is indication of misuse of information and though detriment was not caused to GML in the matter, yet the actions of Mr Foster have made him liable for insider trading. Hence, civil liabilities have been incurred by him in this situation. Mr Huckenfusser is in the position of an employee in GML and is neither an officer nor a director there. Because of his work profile, he gathered the information about the stock prices of MMM and passed on this piece of information to an outsider Mrs Duck. This information was let out only with intent to gain personal advantage and to set off his debts in the matter. Mrs Duck has got no action or liability in this because that entire she did was she sought from some independent financial advice from her brother-in-law[10]. However, it is worth noting here that Mr Huckenfusser succeeded in giving this information because of his position and this is a breach of fiduciary duties that have been given to him. Thus, it can be said that though Mrs Duck is not liable in the matter, Mr Huckenfusser is. Defenses Dr Dawes acted honestly in the matter and though he gained monetary advantage his bankruptcy was known to GML. Though certain provisions of law have been contravened by him, he is not guilty under law and can claim immunity under Section 1317S[11]. Mr Foster in the matter has no available remedies and he can only state that GML did not incur any losses because of his actions. However, this is not a valid defense and there needs to be an independent procedural investigation taken up by ASIC in the matter[12]. Mrs Duck has total immunity in the matter because she is not in association with GML[13]. She only took financial investment advice in the matter in absolute good faith. Based on the advice she obtained, she acted and hence she has not breached any law or provisions of the Corporations Act[14]. Remedies There are certain civil remedies in the matter. As and when a breach of duty is proved, the Courts can choose on any of the following remedies: For contravention of the law, a pecuniary penalty amounting to $200,000 may be imposed; The accused may be asked to pay compensation for damages under Section 1317E of the Corporations Act as a civil penalty; The directors might also face disqualification in the matter from the management of other companies[15]. Conclusion Thus, in this matter, it can be concluded saying that there are certain people who have beached the provisions in the matter but there are also some who have not made a breach under Section 183 of the Corporations Act. Hence, civil penalties can be imposed in the matter. But, it should be noted that procedural process has to be independently taken up in the matter by ASIC before any breach is declared in the matter. These burglars have the belief that burglary is okay because it is a matter of â€Å"day to day survival†. This shows that they have their own interpretation on what they think is right and wrong which is a learned definition favorable to crime. This is an incident where you could say that a person may have the opportunity to learned new strategies and techniques that have worked for someone else in the past. Another technique that gets learned on the streets is the ability to maintain and develop status. One of the participants shared that it is mandatory to be perceived as â€Å"hip†. People on the streets learn through interactions with each other what it takes to be hip and be seen as someone with high status. 95% of the participants confessed that they spend the money that they steal on things that give them the image of â€Å"high-living†. During the interview several things were revealed as things to do in order to gain that high status. These burglars can learn these techniques such as doing drugs, having sexual partners, the right styles and brands, and a car and car accessories, as things to pursue in order to gain that respected status in the street culture. It is already made clear that these burglars live in poor neighborhoods and are living on the streets which give them more objective opportunity than someone that is in a nicer well off neighborhood. Due to their neighborhood, it exposes these burglars to people that are promoters to committing crime (Hagan, p.90). This change was accounted to the introduction of Larkin to the poetry of Thomas Hardy who there after became a strong influence in his works from that point on. Upon reading the first stanza and even beyond that this rhyme and rhythm adds to the dark tone. The syntax and use of language also help convey the message of unconquerable doom that I feel is clearly apparent in this poem. Its use of imagery in relationship to the metaphors using commonplace things to describing peoples hopes and aspirations and eventual death I find very interesting and obviously the driving force of the poem. The Rhyme pattern of aa, bb, cc, dd, ee, ff, gg, hh, ii, jj, kk, ll along with the trochaic rhythm seems to move this poem solemnly from couplet to couplet. When one reads it to themselves or aloud theses characteristics seem to develop the poems dramatic theme. The syntax looks to help in the rhyming of the couplets. As shown in lines nine through ten â€Å"Yet still they leave us holding wretched stalk Of disappointment, for, though nothing balks.† The use of enjaments and endstoped lines throughout this poem although tricky for me to perform out loud I find still are an important and crucial in setting the tone and moving this piece along. The tone of this poem is introduced with the first two sentences â€Å"Always too eager for the future, we Pick up bad habits of expectancy. Something is always approaching; every day Till then we say.† Starting out with this bleak statement and then continuing on that path. The tone progresses from there by using the imagery to express the metaphors. The important images are the sparkling armada, which is a metaphor for the good fortune mankind awaits. The wretched stalks we hold being our contempt for those ships that hold our prize the one that we will never get. The ship of hope itself described in lines eleven through fourteen. Finally the last image in the last stanza is where the tone shifts a tad from being dark to now even a bit darker. The one ship that is seeking us, the black sailed ship towing nothing but silence and not even making a break. This image is most noticeably a reference to death. The poem in all is a metaphor sustained from begging to end (characteristics of an allegory) about the hopes people have and how we always wait though they never come to fruition. We wait for all the good we think is owed to us but the only thing that awaits us for sure is quite death. The next poem is â€Å"This Be The Verse,† which is comparatively different from the first poem. For starters there is no ongoing metaphor. The tone of this poem and the meaning are very forefront and out right. It has three stanzas all quatrains, its iambic; the rhyme scheme is ab, ab, cd, cd, ef,ef. I consider the tone of this poem to be a cynical warning about becoming a parent. It essentially says that know matter who you are or how you try you are going to â€Å"embarrass,† your kids up. Hard times by Charles Dickens Essay The book Hard times, relates to the hard times that people were going through at the time of the industrial revolution, during the 1840s. the book was published in 1850, so that when Charles wrote the book, he was looking back on the events that occurred 10 years earlier. In his book Hard Times Dickens focuses on education and how children used to be taught. Dickens does not agree with the type of teaching that was going on in those times, and by making the characters of the story his object of hate, it makes them prime targets of ridiculing, and does so throughout the book. He describes how the educators insist on teaching fact, and fact alone, nothing but fact. This way he can put forward his views and feelings of this form of teaching, by ridiculing the characters and continually ripping them apart with criticism. The educators insist on teaching fact and pluck all the opinion from the tiny fragile minds that can be so easily moulded into fact filled objects. They scoop out every little fragment of imagination, not leaving the smallest detail to spare and replace it with fact, fact, fact, until they are over spilling with them. As if when filling an empty money box with pennies until it is full to the brim and over flowing, and when you take off the lid they all pour out, one after the other, penny after penny, fact after fact. Facts were ridged and solid, there was no room for interpretation, or another view on the matter, a fact could not be disproved, or argued against, a fact was a fact, and that was what the educators were trying to pour into the innocent little minds, once filled with imagination and opinion. Dickens chooses the names of characters very well. Such as Grad grind, this gives an impression of a strict, hard faced man stuck in his ways. Dickens is very descriptive which gives the reader an image of the characters, and yet at the same time he leaves other aspects to the imagination. The educators were filtering out the opinion and imagination, leaving room for only the facts to get through. This is what Dickens disliked about this form of education, he thought that each child should be independent, and have their own opinion of things and have a free imagination. Dickens himself was a very bright child, yet was denied the right to education, due to the conditions of the time, and the fact that his family were so poor. He left school at the age of 14 and went to work. This is the main reason why Dickens feels so strongly about education and he feels that people should do what they want to do not what they have to do, as he had to leave school in order to get a bit more money for his family. In chapter 2 we learn that the teacher Gradgrind has little, if any respect for the children as he refers to them by numbers, also he criticises on of the girls names. He forms the impression of a very narrow minded man with little consideration or respect for children. He is full of fact and stuck in his ways, he believes that because he has been taught facts that every one should be taught pure fact. Dickens doesnt like this way of learning, and continually ridicules it and the people teaching it. Dickens gets his points across through satire and comic exaggeration, he uses this to achieve humour and also as an extreme way of getting feelings across. During the Victorian times people had a very dim view of education, they did not think it was that essential for children to learn, however in the Victorian times it all came down to your social class. If you were upper class you would have had an education, however if you were lower class you would be considered very lucky if you went to school and even then you would have hat to have left school early to work to get that extra bit of money for the family. I thin these views existed because people had no idea of the importance and it all came down to your social class, also children were ill treated and expected to be seen and not heard. These views of education are very wrong as it is now important especially as we have more rights, and people are respected more.

Introduction We live in a world where access to most resources (thanks to the internet) are just a click away. The only resource that seems to be struggling to reach to the majority of the world through this method is schooling or education. Is it possible for education to remove the walls around our schools? Can our current model of education be replaced by online learning? Global How has online learning affected our world? Online learning has been out there since search giants like Google, Yahoo and Bing were set up. The only difference between now and then is that earlier it was difficult to prove that you had knowledge about a subject because there was very little proof of what you knew unless you could demonstrate it. Earlier all organizations mandated proper certification or documents of qualifications. Its only now that online learning offers proper certification. And in accordance to that online learning is slowly getting accepted in companies and organizations with the proof of the certificate(s) achieved by doing so. Online learning offers courses on everything from counting on your fingers to university level Astrophysics. As of 2013, the number of people in Colleges 183 million Secondary School 568.5 million Primary School 713.6 million Total number of students 1.436 billion (20.5% of the total population in 2013) The laws that govern population growth entail that these numbers would have grown in the past 4 years and would be approximately 1.501 billion people (20.5% of 7.461 billion {total population}). According to EdSurge the number of learners on the big 3 online learning sites (edX, Coursera and Udacity) were a stunning 24 million. India In countries like India where students are pushed to their mental and physical limits to achieve grades that yield are a 100 percent average or the equivalent, these certificates show another stairway to success to these students. Students now turn to websites like edX, Coursera, Udacity and Khan Academy to learn whatever they need to or in several cases want to. This also allows the students to excel in their studies, and get better career opportunities in their future, as online learning shows an effort to learn beyond what is expected of a student. The Rajasthan state government is going to add Khan Academy lessons as part of their day to day school curriculum to provide their students with a platform with universally accepted teaching-learning models and techniques. But due to other problems like poverty and availability of electricity (which I will address later) it is difficult to switch over to online education. China In China the number of universities and colleges offering online learning platforms has skyrocketed in the past years. 30 out 110 of Chinas well-known universities have an online learning platform. Chinas ministry of education has been encouraging a lot of students to take online courses, however no university is allowed to give out degrees. Another advantage to online learning is that you can view videos/lectures as many times as you need to. You can ask for help on forums on many online learning sites. Online learning also offers a lot of different perspective and immense exposure. Google was one of the first multi-national organisations to employ people not based on their qualifications or proof of knowledge/learning rather based on their skills and experience. There is an option for the learner to avail for the Honour Code Certificate but courses offering these certificates are extremely few and when a learner presents an honour code certificate as part of their CV or rà ©sumà ©, they are looked at with suspicion as the terms of the honour code are literally honouring your word. The reason honour code certificates and statements of achievement (based on the honour code) were stopped is because of misuse of the fact that there was no way to verify (branching out to Verified Certificates) that the person doing the course is the person whose name is on the certificate. On the other hand, verified certificates use a government issued ID to function and the name on the certificate has to match the one on the ID. This reduces chances of someone else doing your work for you. A problem with certification for online learning and online courses is that almost all the verified certificates on the most online learning platforms are now paid and the se prices are very high. A lot of the paid/verified certificates on edX are for $50 and quite a few of them are for a hundred dollars. As a matter of fact, Udacity has a minute number of free courses and all other courses on Udacity are paid. This makes it difficult for a learner to get these certificates because of the cost of these certificates. This reduces the number of learners completing the course, contary to what is said by edX when a user enrols into a course Its a proven motivator to complete the course. These prices can create a barbed-wire around the school we are trying to render wall-less. Another fact worth considering is, that in a lot of countries schooling/college is expensive and using free, online resources can help you save all that money. For the world as one, I think the developed countries (like the United States) should start by using online education to enhance and ultimately replace their current models of education. By doing so, they would set an example and would encourage other countries to be like them. National Is replacing the current model of education with online learning feasible in my country? According to the Indian Ministry of Social Justice and Empowerment 27.5% of Indias population is below the poverty line, which is roughly 367.48 million people (Population of India à ¢Ã¢â‚¬  Ã¢â‚¬â„¢ 1,336,286,256 * 27.5/100 = 367478720). I believe, asking students/people who are underprivileged to learn using online resources, is inappropriate because having an internet connection is expensive and without one online learning is impossible. So its almost like saying the water is free but the way to get to the water is paid (and expensive). So I do not think it is feasible to replace my countrys current model of education with online learning. Local Is replacing the current model of education with online learning feasible for the students in my school/community? According to a survey I conducted among my friends on my social networking circles (Link to responses available in the bibliography below) à ¢Ã¢â‚¬  Ã¢â‚¬â„¢ 98.3% of the people use the internet for learning something, studying and/or work. Most people use the internet for 5-8 hours a day. 22.4% of the people use google and/or other search engines to learn what they want to. 5.1% also use Khan Academy and use search engines. 1.7% use Khan Academy and similar websites for studying. 6.9% do the points mentioned above and also use edX, Coursera and similar platforms for studying. 3.4% use Khan Academy and edX/Coursera and other platforms for studying. 11.9% use the internet for college/university work and use all of uses mentioned above. 49.2% use all/some of the tools mentioned above and also work. Keeping the above points in mind I believe that my friends circle can depend on the internet for schooling/education or can use the internet to enhance this essential process. Personal As an individual I believe I can switch over to the Internet for my education as I have no problems with Internet access, and the colleges/universities I am considering for my further education accept and even encourage online learning and certification, which again is not a problem with me. I find that I can fit into that group of people who can and should turn to online learning. I find that using E-Books and E-Lectures is more convenient and environmentally friendly (using E-Books rather than books). I can also get my hands on to material that sometimes teachers in class might not be able to cover. I think that replacing the current model of education with online education is possible for me, although I might require a teacher to guide me at times. Personal Response My research and essay were partly inspired by Salman Khans (educationist) Ted Talk (in 2011) and I had turned to online resources for learning. Salman Khan tells us how the traditional academic model is not cut out for the extremes of the Bell Curve the students who find a topic/subject easy, and the ones who dont, but the system is rather suited for the average student. He says that, just like in Music or Martial Arts, you only move onto a further skill once youve mastered the basic. But as all of us know, most of our schools cannot compensate for the students who lag behind in a subject/concept and the class simply has to move on. He uses the cheese-block analogy and demonstrates to us how minor gaps in our knowledge can make the cookie crumble (the cheese in this case!). So I see myself working on Khan academy to do the best I can and learn all I can because according to Sal Khan You only need to know one thing You can learn anything. This will help me and can also inspire othe r people to be like me. Possible Future Scenarios The world needs to realise that traditional schools and curricula will not be able to cope with our rapidly changing world. Getting the world to accept online resources as instead of/to enhance our education, we need a little amount struggle to overcome the natural resistance to change that we have, monetary funding and support from governments of the world (in terms of providing cheap internet access and pushing learners to use online resources). After taking these steps the world would slowly but surely be a better place. The world can simply ignore the fact that online education holds the key to our future and would not embrace online learning, which would cause problems several other problems (like availability of space for schools, teachers and staff required to run the school and availability of books etc). It would also cause a rise in illiteracy and poverty (since it would restrict learning and schooling to schools and colleges only). Taking into account my research, I think that this scenario is not very likely to occur. The world can realise this fact now and can help our future generations to focus on keeping up high in the sky rather than getting out of problems like illiteracy and poverty. Considering what I learnt through the course of my research, this scenario is very likely to occur. The world can move toward Scenario 2 but might not be able to make enough progress due to problems like poverty, illiteracy and lack of access to the internet. This would cause these problems to grow further.
